King's Brief for the Prosecution of Gaviani for Voluntary Manslaughter of Loral, submitted by Cpl. Niven

Statement of facts:

There is no dispute in the statement of facts for this case. On the 22nd of Sojourn, 235, Gaviani the sorceror was standing in the main entrance hall of the Adventurer's Guild in Sable. Gaviani decided to attempt the magical process of enchanting an item while standing there in the main entrance hall. During this process, a young newcomer to the land named Loral awoke from slumber in the entrance hall. The magical process of that Gaviani was casting went awry and an explosion occurred. That explosion killed Loral.

Argument:

In his interview, Gaviani admitted that he knew that a failed attempt at enchanting an item would result in an explosion that could kill a young adventurer. Additionally he admitted that he was aware of the fact that many young adventurers awake in the entrance hall or travel through that area frequently. {Loral-Gaviani.Gaviani}

Conclusion:

Due to the fact that there appears to be no intent to actually kill any adventurer, this is a clear case of voluntary manslaughter. The magical process used by Gaviani is known to be potentially dangerous to those around you and was conducted in a very congested area. While only an error in judgment, this is still an action that a reasonable person would conclude was reckless, as opposed to merely negligent.

Due to Gaviani's cooperation, and the fact that no malice or intent was evident, the prosecution recommends a fine of 10 orb. 2 orb to be paid to Loral and 8 orb paid to the Justicars.

To all those concerned upon this matter, and heretoforein in formal response to the brief written by the prosecution in "Rex v. Gaviani":

I hereby waive my right to respond to the prosecution's brief in kind, as I have been duly informed the repercussions therein, and would, instead, state a few lines for the Judge and, for that matter, legal public at large upon this matter:

My act was an ill-planned, and I fully accept the consequences for such a composition. I do most certainly wait with bated breath to serve a pennance which might give me the opportunity to rectify this most ill of deeds.

I affirm that which is stated within the prosecution's allegation, and supplicate myself to the justice of the Judge of Bilanx.
