King's Brief: Crim222-1p

=================================================
 Docket Number: Crim222-1p - Rex vs. Wyden
=================================================
 Brief for the King, submitted by Kyrteon
=================================================

Prosecution of Wyden for the Murder of Ubi and Falcore Submitted by Kyrteon, Corporal of the Justicars

On or about the 8th of Thawing, 220, Ubi the Fighter and Falcore the Mage boarded the Cutter bound for Sable, from Thrace. Shortly thereafter, Wyden the Paladin also boarded the Cutter. Wyden testified that he was not with Ubi or Falcore during the attack, but in the Green Griffon and his temple. However, statements from Ubi, Falcore, Sajek the Psion, Kard the Mage, and Ella the Thief, all corraborate that Ubi and Falcore notified friends of Wyden's boarding of the Cutter.

The afformentioned testimonies also press the evidence that Wyden in fact attacked Ubi, then afterward killed both Falcore and his familiar. Ella testified that Ubi called out to her during the attack and in a frantic moment Sajek heard Ubi call out on his clan link. Kard also heard Falcore call out on his guild channel that he was under attack by Wyden.

Ella also testified that one month prior to the incident Wyden was on board a boat with Ella, Ubi, and several others and Wyden claimed he could kill Ubi right there if he wanted to.

These testimonies alone could be written off as hearsay if it were not for the testimony of Akrm the Bishop of Bilanx, and Aeris the Justicar. Both of whom went to the cutter upon hearing of the possible deaths and spoke in clerical fashion to the spirits at the Cutter. Both Akrm and Aeris testified that the spirits showed Wyden as the murderer.

Recommendations:

The Prosecution believes that Wyden's attack could have been premeditated as shown in Ella's testimony, it definately was aggressive and without remorse. Therefore, Wyden should punished to the extant of the law and the victims adequately compensated.
