Prosecuter's Brief for the Judge, eferencing the Prosecution of Dalaena for Assault on Krytin as submitted by Kyrteon

While in the guild showing a new member the rules and areas of the Cleric's Temple, Dalaena and the new cleric, Xena, met with Krytin a fellow Guild member. Upon meeting the guild member an argument ensued stemming from a comment that Dalaena claimed was directed at her, and Krytin claims was made as a general statement. Both parties agree that the comment consisted of Krytin voicing his oppionion about a murder that occured in the Guild.

According to Krytin, the he made the comment saying that it was unfortunate that someone was murdered in the guild and Dalaena took exception to this and made a comment to which he laughed at at which point Dalaena struck out and smote him, although he states rather lightly, because he was only mildly wounded and he fled not being pursued by Dalaena.

Dalaena claims she was accused of murder and that an argument ensued to the point of Krytin insulting her with his disrespect and he laughed at her when she tried to tell him to leave her alone. Krytin, however, does not recall such an argument only that she said something and he laughed.

Xena, the witness, claims that she heard the argument but was unsure of exact events nor did she understand what was being said. She only heard arguing then witnessed Dalaena smite Krytin.

Because the facts are not completely clear in this case nor does the witness recollect anything other than the argument in "general" and that Dalaena assaulted Krytin, It is the position of the prosecution that Dalaena should be fined for minor assault of a guildmate until further evidence can be shown to prove reasonable slander and/or disrespect.

I would like to point out that many other guilds, Fighters and Thieves Guild in particular, often discipline their younger members for disrespecting any Elders. Kyrtin was an acolyte at this point in time, and I am a High Priestess and chosen by Erosia. Kyrtin even admits to laughing at a statement made by me, obviously scoffing at what I said. He first started talking about the murder, never directly accusing me but implying that I had committed murder in the guild. I, of course, was unhappy about these statements and told him so. Then I simply, at the time, repeated the contents of a message sent to me by the Creator, someone definitely not to be ignored. Kyrtin, instead of being quiet or apologizing as he should, continued to ignore my comments and was rather rude by laughing and scoffing at me. Finally, I told him to leave since I was showing a new person around. At this, he continued to laugh and scoff some more. Thus, I then blasted him with a bolt of electricity to move him on his way. In no way did I try to kill him, though I feel that he rightly deserved it, and I would be justified in that killing. Instead, I kept in mind that he was young and needed to be taught a lesson. I told him to stay out of my way and to get out of my way. He was smart and left.

He and his cohorts have continually accused me of his murder and other murders. Deokoria and Blaez have both been witnesses to this. Morever, two members of the Triumverate have been asked to 'speak to me' and 'take action' and do something about me 'attacking and murdering' those in the guild. Again, the guilds of Sable have never been declared a 'sanctuary' or 'haven' which Kyrtin claims in a letter to Torm. (The letter is enclosed below.) Moreover, Kyrtin tried to call me a heretic, and I believe that is one of the highest insults possible to give to a chosen of any god or goddess. He has never been honorable in his intentions in mentioning the murder and trying to implicate me of murder. I have killed one person in the guild, and that was during the time of Virulent's invasion. I do not remember the name of the cleric, but he completely ignored any guild directives and continued to act with only thoughts of his personal glory. He also attacked the city's savior, Alexander, after Virulent was dispatched. That is the only time I've ever slain another cleric within the guild or without the guild. Thus, Kyrtin and Kreanne's accusations have been very hurtful not to mention just plain annoying.

Xena was brand new, and I was trying to show her around. Obviously, I care a great deal about our guild and my reputation in the guild. Krytin tried to accuse me of murder in front of a brand new cleric of the good ethos. He put my reputation at stake and refused to leave when corrected on the matter. Again, I believe I was more than entitled to the attack since peaceful tactics had not worked.

In conclusion, I was acting in my position to defend my reputation in the only manner left to me. I believe that I acted justly and explained the reasons for acting as I did. Krytin insulted me and disrespected me as a guild elder. I acted to defend my position and honor.
