King's Brief: Crim182-2p

I was killed by Drazz after the Judge proclaimed me innoecent. Haldir (who was at COT when the descison was made) says, and i quote "I remember reaper and Drazz in COT with nobody there" i was not there yet. I had been hiding in the Guild of Fighters where i had waited for the descison. After the descison was proclaied i came down to COT where i went ld (althought the machine didnt reconizige) and did notthing thereafter (for i was ld). Upon my return i was dead and was to ld Drazz killed me After i attacked him. the amazing concidence that Reaper (a supporter of Drazz) and Drazz where at COT before i arrived there and then am killed there is not a concidence. Drazz killed me when i arrived at COT and Reaper might have helped him.

Clearly, I am the victim of this case, while serving the criminal, Negritas with a warrant for charge in assault on Manc, I went to find him. I found him and Cruz standing outside of the tavern on Via Vendeur. When I proceed to question Negritas, and deciding on if he truly was at fault, I was attacked by both Negritas, and Cruz. It was clear to me then, that I had to fight back. The remainder of the time, I chased down the criminals, as I felt should be necessary, I responded the only was I could, in Self-Defense. It was at that point, I decided that if Cruz was not handled, he would only harass me and more newbies, namely Manc and Reaper, who were both attacked by Cruz yesterday. As the only present officer of the law at the time, I felt that if matters were not handled immediately, they would only escalate. Cruz himself, fled to his guild, hiding as he said, waiting for the verdict of Manc, and then he proceeded to the COT where he conveniently when Link-Dead, or ld as he put it. However, I was not attempting to punish Cruz for his attack on Manc, I was retalliating for his attack on me. He should have had no reason to fear me from Manc's case as I issued a warrant, served it, and filed a report according to proper police procedure. Then I left it in the law's hand to decide. It was soon after I served Cruz, that another member of the Clan Pandemonium, attacked a civillian, but you already know that story, in as such, I'll wager that Cruz will think twice before recklesslly attacking newbies and police officers.

They will testify that I acted out of self-defense, and although Manc and Reaper have had a history with the two Clan members, I assure you that Arcticboy will prove an invaluable resource.

In closing, I would also like to file reverse charges, against the entire Clan Pandemonium. I believe that it is the Clan's influence, or the Klan as I would like it referred to now, that caused these once admirable citizens to become openly violent and hostile. As well I have suffered punitive damages, been harassed publicly because of this, and my job, which means the world to me, is being threatened. I am clearly the victim of this, and as such should be helped not hindered.

Addendum:

Also, I would like to bring to light my reasoning for my case against the entire Klan Pandemonium. Just as the entire force looks bad because of the charges brought against me, or a sports team would look bad if a player did something he shouldn't have, the entire group would suffer. That is why I feel the entire Klan should suffer.

Rex v. Cruz Crim 182-1 Cuspis 5, 182


Facts: One Manc reported being assaulted by one Cruz, both citizens of Sable. Upon investigation by the Sable City Police, the victim was shown to have markings on his body indicative of a violent attack. Based on the report an indictment was entered by the Judge.

Decision: The facts of this case, if proved, would be sufficient to establish that Cruz committed both an assault and a battery on the victim Manc. It is clear from applicable case law that the standard to which proof must rise is CLEAR AND CONVINCING EVIDENCE. That is, the trier of fact must find, to that level of certainty, that the alleged crime did in fact occur. This standard of proof exceeds the preponderance of the evidence standard, which would allow conviction if the trier of fact believed that, more likely than not, the alleged crime did, in fact, occur. Yet the clear and convincing evidence standard falls short of reasonable doubt.

In this situation, I find that the prosecution has failed to meet its burden. There were no witnesses to this crime that the prosecution can produce. Investigation by this office reveals that the victim was out alignment and, as a consequence, was healing very slowly. Thus the wounds observed by the reporting police officer could have been caused by any number of factors, including the perpetrator of the alleged crime. But since there are numerous explanations for the presence of markings on the victim there is no substantially clear explanation as to how the markings actually got there. Therefore, while it is certainly POSSIBLE that the victim was attacked by Cruz, it is far from Clear and Convincing.

The charges against Cruz are dismissed. The City of Sable may not refile any claim based on the course of events considered in this decision.
